Liability Waiver

The following section 1 through 4 shall be known as The Agreement.
1. Assumption of Risk

I hereby consent to his/her participation in tennis classes and all other activities offered by Sports Town Sdn. Bhd. I understand that participation in tennis classes and any and all other activities offered by Sports Town Sdn. Bhd. may result in unavoidable injuries including, but not limited to muscle or other soft tissue strains, sprains and tears, broken bones, and severe injuries such as paralysis, permanent disabilities, or even death from various causes, known and unknown, which include but are not limited to the heights of the equipment and the body during certain movements, rotation of the body, and movement of the body in a unique environment. I am fully aware of the inherent risks involved in tennis and any and all other activities offered by Sports Town Sdn Bhd and the possibility of injury from participating in the aforementioned

2. Release of Liability

In consideration for allowing myself to participate in activities offered by Sports Town Sdn Bhd, I, my heirs and assigns, next of kin, and all others acting on my behalf agree to waive any and all rights, claims, damages, actions, causes of action or suits of any kind or nature whatsoever which I have against Sports Town Sdn Bhd. or any agent, employee, contractor, representative or other acting on their behalf and to fully indemnity for any injuries suffered as a result of engaging in those activities offered by Sports Town Sdn Bhd. It is also my intent to release Sports Town Sdn Bhd and any agent, employee, contractor representative or other acting on their behalf from liability for ordinary or gross negligent conduct that may occur in the future and agree not to sue. Should any part or parts of this agreement be held null and void, the gross balance of the gross agreement shall remain valid and maintain its full force and effect. This acknowledgement of risk and WAIVER OF LIABILITY has been read by me and understood completely and signed voluntarily. I am 18 years of age or older. I take full responsibility for my actions and agree to pay for any and all medical bills that might arise from an accident at Sports Town Sdn Bhd this could include, but not limited to twisting an ankle, broken bones, torn ligaments, spine injuries or even death. This includes outside the building in the parking lot and all surrounding areas.

3. Medical Emergencies

I fully understand that the staff and contractors of Sports Town Sdn Bhd, are not physicians or medical practitioners of any kind. With that in mind, I hereby release Sports Town Sdn Bhd to render first aid to myself in the event of any injury or illness. I also release Sports Town Sdn Bhd to call an ambulance if they are unable to contact myself, the guardian or my nominated next of kin, or if they deem it otherwise necessary due to the severity of the accident. I also hereby agree to pay for such ambulance. As a parent or legal guardian, I agree to provide health insurance for the minor child and/or guarantee payment of any medical expenses incurred as a result of training, performing, or participation in activities with Sports Town Sdn Bhd. I hereby agree to inform Sports Town Sdn Bhd of any medical conditions (mental or physical) or medications they should be aware of, including but not limited to breathing problems, seizures, allergies, Downs Syndrome, dizzy spells, previous neck or spine injuries or conditions, broken bones, high blood pressure, diabetes, autism, epilepsy, heart condition etc.

4. Waiver of liability

I/We hereby understand and acknowledge that the classes, training, programs and events held by the Sports Town Sdn Bhd may expose me to many inherent risks, including accidents, injury, illness, or even death. I/WE assume all risk of injuries associated with participation including, but not limited to, falls, contact with other participants, the effects of the weather, including high heat and/or humidity, and all other such risks being known and appreciated by me. I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity. I/We acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in. After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and Sports Town Sdn Bhd furnishing services to me, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVER AND RELEASE the Sports Town Sdn Bhd, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in the Sports Town Sdn Bhd training, programs and/or events.

By my signature I/We have indicate that I/We have read and understand this Waiver of Liability. I am aware that this is a waiver and release of liability and I voluntarily agree to its terms.
